Agreement to Terms

By accessing and using FreeDFYWeb's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Service Description

FreeDFYWeb provides professional website design, development, hosting, and maintenance services. Our service includes:

• Custom website design and development
• Web hosting on our servers
• Regular maintenance and updates
• Technical support
• Security monitoring and backups

Contract Terms

Contract Duration

All services are provided under a 6-month minimum contract. This ensures we can deliver the best value and maintain the quality of your website over time.

Delivery Timeline

Your custom website will be designed, developed, and delivered within 7 business days of receiving all necessary content and materials from you. This timeline may be extended if content or feedback is delayed.

Monthly Updates

Your service includes 2 updates per month. These updates can include:

• Page content updates
• New page creation
• Design modifications
• Feature additions
• Image or media updates
• Text changes and corrections

Additional updates beyond the monthly allocation may be available for an additional fee.

Payment Terms

Payment terms will be outlined in your service agreement. We offer flexible payment options including monthly subscriptions and deferred payment plans. All fees must be paid in accordance with the agreed payment schedule.

Late payments may result in service suspension. A late fee may be applied to overdue accounts.

Cancellation and Termination

Early Cancellation

If you choose to cancel your service before the end of the 6-month contract period, the following terms apply:

• You must obtain your own web hosting server from a third-party hosting provider
• FreeDFYWeb will migrate your website to your new hosting server at no additional charge
• Any outstanding payments for services rendered must be paid in full
• After migration, FreeDFYWeb is no longer responsible for website maintenance, updates, or support

Contract Completion

After the initial 6-month contract period, services will continue on a month-to-month basis unless either party provides 30 days' written notice of termination.

Termination by FreeDFYWeb

We reserve the right to terminate services immediately if:

• Payment is not received within 15 days of the due date
• You violate these Terms of Service
• Your website is used for illegal activities
• You engage in abusive behavior toward our staff

Intellectual Property

Your Content

You retain all rights to the content you provide (text, images, logos, etc.). By providing content to us, you grant FreeDFYWeb a license to use, modify, and display this content as necessary to provide our services.

Website Design and Code

The website design, code, and custom features created by FreeDFYWeb remain our intellectual property during the contract period. Upon completion of the 6-month contract and full payment, you receive a license to use the website design and code.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information
• Supply all necessary content, images, and materials in a timely manner
• Respond to requests for feedback within a reasonable timeframe
• Ensure all content provided is legal and does not infringe on third-party rights
• Maintain the confidentiality of any login credentials provided
• Use the website in compliance with all applicable laws and regulations

Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However, we do not guarantee:

• Specific search engine rankings or traffic levels
• Uninterrupted or error-free service (though we strive for 99.9% uptime)
• That the website will meet all of your business objectives
• Compatibility with all future browser versions or devices

Limitation of Liability

FreeDFYWeb shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. Our total liability shall not exceed the amount paid by you for services in the 6 months preceding the claim.

Refund Policy

Due to the custom nature of our services, refunds are generally not available once work has commenced. However, if you are unsatisfied with the initial design draft, you may request revisions or, in exceptional circumstances, discuss cancellation options with our team.

Hosting and Maintenance

FreeDFYWeb provides hosting on our secure servers as part of the service package. We handle:

• Server maintenance and updates
• Security monitoring and patches
• Regular backups
• SSL certificate management
• Performance optimization

You are not responsible for any technical server management during your contract period.

Dispute Resolution

Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify active clients of any material changes. Your continued use of our services after changes constitutes acceptance of the new terms.
